Kenya’s Supreme Court has dismissed two consolidated petitions challenging the fresh Presidential election of 26th October saying President Uhuru Kenyatta was validly elected.
In a unanimous decision read by Chief Justice David Maraga, the Court was clear that the petitions lack merit saying the petitions by Harun Mwau and Njonjo Mue didn’t sufficiently prove that the election was flawed.
In the ruling, Maraga said “The court has unanimously determined that the petitions are not merited and the final orders are that the petition by John Harun Mwau versus the Independent Electoral and Boundaries Commission and two others as consolidated is hereby dismissed.”
“As a consequence, the presidential election of October 26 is hereby upheld as is the election of Uhuru Kenyatta” the ruling stated.
Maraga said the full judgment will be issued within 21 days, while plans to swear in President Uhuru on November 28th are already in place.
Attorney General Githu Muigai welcomed the ruling saying “there is no perfect election, there will always be errors in an election but you can’t invalidate an election unless those errors meet a certain threshold.”
National Assembly Majority Leader Aden Duale said they will now embark on swearing in the President so that the Country can move forward.
Duale said President Uhuru must now untie the Country regardless of who voted for him and who didn’t.
He called on the opposition to respect the ruling saying when the Supreme Court invalidated President Uhuru’s election of 8th August the President and his Deputy respected the ruling and went back to the ballot.
He said Supreme Court is an independent body, and its decision must be respected.
Presidential candidate Ekuru Aukot called for unity among Kenyans saying as an opposition they will keep the Government on its toes to ensure it delivers on its promises.
Aukot condemned any sort of violence in the Country and urged President Uhuru to ensure that no life is lost due to political competition.
