Kenyan school fined for sharing photos of pupils without parents’ consent

A school was fined $31,000 (£25,000) by Kenya’s digital regulator for publishing student photos online without their parents’ consent.

This move is the first of its kind by the Office of the Data Protection Commissioner.

A night club and a credit company have also been fined $12,500 and $20,000 respectively.

The club allegedly posted a customer’s photo on their social media accounts without that person’s consent, according to the regulator.

Using information acquired from third parties, the credit company also threatened customers through phone calls and text messages.

A public debate about the right to privacy has been sparked by these fines, particularly in clubs and bars.

Some of these places have now posted notices stating that anyone entering their property consents to be photographed, filmed, or recorded without compensation and that anyone who disagrees with their rules should not enter.

The regulator stated in a statement published on X that it hoped the penalties would serve as a warning to organizations to abide by the nation’s data protection laws, including those requiring them to obtain consent before publishing people’s pictures online.
