Speaker of Parliament rejects Supreme Court writ, citing constitutional violations

The Speaker of Parliament, Alban Bagbin, has rejected a Supreme Court writ instructing him to declare four parliamentary seats vacant.

In a letter from Deputy Clerk Ebenezer Ahumah Djietror, it was noted that the Speaker has instructed that the writ be returned to the Supreme Court. The letter explained that the writ, which was left by bailiffs attempting to serve the Speaker on October 15, 2024, violated Article 117 of Ghana’s 1992 Constitution.

“I am directed by Rt. Hon. Alban Sumana Kingsford Bagbin, Speaker of Parliament, is to return the documents left at the Legal Services Office by three bailiffs on October 16, 2024. Attempts to serve these documents were made on October 15, 2024.

“The Rt. Hon. Speaker observes that this attempted service contravenes Article 117 of the 1992 Constitution, as well as a circular issued by Her Ladyship Justice Cyra Pamela CA. Korangteng (JA) dated July 12, 2024, regarding the immunity from service of process and arrest,” the letter states.

The letter concludes by directing the return of the documents for further action.”
