Wesley Girls SHS sued for allegedly denying Muslim students religious rights
A lawsuit has been filed against Wesley Girls’ Senior High School (SHS) for allegedly denying Muslim students the right to practice their religion.
The legal action, initiated by Shafic Osman, a Ghanaian citizen, accuses the school of systematically restricting Muslim students from observing their religious practices.
The plaintiff contends that the school’s policy violates the 1992 Constitution, describing it as “contrary to and inconsistent with the provisions of the Constitution.”
The suit seeks several declarations, including one stating that the school’s prohibition of Islamic practices infringes on the religious freedoms enshrined in the Constitution.
Specifically, the lawsuit claims, “The 1st defendant’s policy compelling and requiring the practice of a compulsory school religion in a public school is contrary to and inconsistent with Articles 21(1)(b)(c) and Article 26.”
It further argues that these limitations “undermine the welfare of Muslim students” and violate international human rights protections for children recognized under Article 33(5) of Ghana’s Constitution.
In addition to the declarations, the plaintiff is requesting that the Ghana Education Service (GES) be directed to develop guidelines ensuring constitutionally compliant regulation of religious practices in all public schools.
