High Court in Kumasi Dismisses Chief Inspector’s Promotion Suit

The High Court in Kumasi has dismissed the suit filed by Chief Inspector Samuel Krah against the Inspector-General of Police and the State regarding his promotion.

The court, presided over by Justice Kwasi Anokyi Gyimah, delivered the judgment on Friday, June 14, 2024.

The court ruled that Chief Inspector Krah is not entitled to automatic promotion solely based on his attainment of higher academic qualifications.

The judgment stated that the plaintiff failed to prove his claim on the preponderance of probability. It emphasized that higher academic qualifications alone do not guarantee promotion within the police service.

The court explained that promotion within the police service depends on the mode of recruitment, which includes competitive examination or special recommendation in line with Police Service Regulation.

The judgment encouraged Chief Inspector Krah to continue attempting the entrance examination, suggesting he may eventually succeed.

Chief Inspector Krah’s case was based on the assertion that despite his 25 to 30 years of service, the Police Administration had promoted his junior colleagues under the same special amnesty, while he was denied similar treatment.

He claimed this hindered his entry into the Police Academy and subsequent promotion to the rank of Assistant Superintendent of Police (ASP).
