Petition to remove Special Prosecutor Kissi Agyabeng sent to Chief Justice by Akufo-Addo
President Akufo-Addo has forwarded a petition seeking the removal of Special Prosecutor Kissi Agyabeng to Chief Justice Gertrude Torkonoo.
The petition, dated April 30, 2024, was submitted by former Special Prosecutor Martin Amidu and was conveyed to the Chief Justice on May 6, 2024.
Martin Amidu’s petition alleges procurement breaches in the purchase of vehicles for the Office of the Special Prosecutor (OSP), abuses involving judges and the administration of justice, and other misconduct.
Specific allegations include violations of citizens’ rights through arrests and detentions, violations of the right to information, and improper appointments of personnel to the OSP.
In accordance with Article 146 of the Constitution, the Chief Justice is currently determining whether there is a prima facie case to establish a committee for Mr. Agyabeng’s impeachment.
Sources suggest that this investigation may be linked to a press conference held by Mr. Agyabeng, during which he claimed that judges had conspired against him, an action Mr. Amidu argues constitutes abuse of judges and brings the judiciary into disrepute.
The impeachment process follows reports that Kissi Agyabeng (Special Prosecutor) declined demands to resign and instead publicly expressed frustrations with his role.
Additionally, Mr. Amidu alleges that Mr. Agyabeng’s arrests of individuals such as Cecilia Dapaah and Prof. Frimpong Boateng amounted to rights abuses, and that his request for appointment letters and salary details of all OSP staff violated the right to information.
