Sekondi High Court Orders Inclusion of Joana Gyan Cudjoe’s Name on Ballot

Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, has been cleared to contest in Ghana’s December 7 general elections.

The Sekondi High Court’s commercial division, led by Justice Gyan-Konto, vacated the injunction against her candidacy, paving the way for her name and picture to appear on the Electoral Commission’s ballot.

Background of the Case

The Electoral Commission had initially disqualified Joana Gyan Cudjoe due to allegations questioning her eligibility ¹. Five individuals challenged her candidacy, resulting in an injunction. Despite attempts to settle outside of court, the parties were unable to resolve their disputes.

Court Proceedings

On November 7, the court ordered the plaintiffs and defendants to resolve their disputes. A hearing was scheduled for November 11, and both parties arrived promptly. The NDC argued that their party structure contradicts the public constitution while contesting the plaintiffs’ application for an injunction. The plaintiffs’ lawyer countered that Joana Gyan’s eligibility remained unresolved.

Ruling and Aftermath

Justice Gyan-Konto’s decision dismissed the injunction, allowing Joana Gyan Cudjoe to contest the elections. Joana urged her supporters to remain calm and continue campaigning despite recent challenges.
