UN court to rule on emergency measures in South Africa’s genocide allegation against Israel

The International Court of Justice (ICJ) is set to determine whether emergency measures should be taken to compel Israel to cease its operations in Gaza amid allegations of genocide brought forward by South Africa.

The case, ongoing for the past two weeks, has seen both countries presenting their arguments. While a ruling against Israel is not legally binding, it holds political significance.

Over 25,000 Palestinians, primarily women and children, have reportedly been killed, and tens of thousands injured since the start of Israel’s offensive, triggered by an attack on Israel by Hamas.

South Africa, supportive of the Palestinians, has requested nine provisional measures, including a halt to Israeli military activity, as the court considers the genocide accusation, a ruling for which is expected to take a considerable amount of time.

Israel strongly rejects the genocide allegation, asserting its right to self-defense, targeting Hamas fighters rather than civilians.

Israel has urged the judges to dismiss South Africa’s request, denouncing it as based on “grossly distorted” and baseless allegations.

In their ruling on Friday, the 17 judges, including 15 permanent justices and one each from South Africa and Israel, must assess whether South Africa’s claim against Israel meets the basic test under the UN’s 1948 Genocide Convention and whether there is a plausible risk of irreparable harm to Palestinians if Israel’s military actions persist.

The ICJ, having the power to issue advisory opinions, can instruct Israel to ensure compliance with international law and guarantee unimpeded delivery of essential supplies to Gaza. While its rulings are theoretically legally binding, they lack enforceability.

If the ruling goes against Israel, it is likely to be ignored, but it would increase political pressure for a ceasefire and prompt international allies to work towards a resolution and ensure humanitarian aid reaches those in need.
