Kenya’s anti-LGBTQ bill proposes 50-year jail sentence
In Kenya, a draft anti-gay law calls for a 50-year prison sentence for homosexual and lesbian acts of sex.
The Family Protection Bill 2023, a proposed law sponsored by Homa Bay Town lawmaker Peter Kaluma, calls for the outlawing of homosexuality, same-sex unions, and all LGBTQ-related activities and campaigns.
Additionally, it aims to outlaw cross-dressing in public, gay parades, assemblies, and marches on the streets.
According to the bill, “A person who engages in sexual act with a person of the same sex without the consent of the other person shall upon conviction be sentenced to imprisonment for a term of not less than 10 years and not exceeding 50 years”.
If the bill is passed, owners of locations used for same-sex relations will have to pay a fine of $14,000 (£11,000) or face a seven-year prison sentence.
In the coastal city of Mombasa last week, clerics and a few civil society organization groups held anti-LGBTQ demonstrations.
This came after the Kenyan Supreme Court upheld its mid-September decision to permit the registration of LGBTQ non-governmental organizations.
The National Gay and Lesbian Rights Commission had been denied registration by Kenya’s NGO Coordinating Board because it “promotes same-sex behavior,” dragging the case for a decade.
In a landmark decision, the Supreme Court declared the action discriminatory and unconstitutional at the beginning of this year, allowing LGBTQ organizations to register.
