The Chief Justice, Gertrude Torkonoo, expressed concern about the behavior of Assin North MP James Gyakye Quayson when he files processes at the Supreme Court.
Chief Justice, Gertrude Torkonoo noted that he often fails to appear in person and has one of his lawyers file and swear to statements on his behalf, which she deemed irregular and must not be encouraged.
The issue arose during a five-member panel hearing a case brought by the legislator seeking to halt his trial. Mr. Quayson argued that the High Court was wrong in denying his request for prosecutors to provide certain undisclosed documents.
The Attorney General stated that all documents had been supplied, referencing correspondence between his office and the MP’s legal team.
Mr. Quayson’s lawyer, Justin Teriwajah, urged the Supreme Court to set aside the High Court’s decision, claiming the evidence used was not properly presented. The Attorney General disagreed, pointing out irregularities in the processes filed by the MP’s legal team.
The Supreme Court ruled that the High Court had committed no error of law and rejected the application. Some panel members commented on the absence of the MP and the practice of his lawyers swearing documents on his behalf, expressing concern about such conduct.
The Chief Justice emphasized that this behavior demeans the legal profession and called for better adherence to proper legal procedures. The case was heard by Chief Justice Gertrude Torkonoo and Justices Issiufu Amadu Tanko, Emmanuel Kulendi, Samuel Asiedu, and Ernest Gaewu.
