Injunction Application aimed at preventing Parliament from considering anti-LGBTQ bill dismissed
The Supreme Court has rejected an application seeking to halt the Speaker of Parliament, Alban Bagbin, from proceeding with the consideration of the anti-LGBTQ bill.
The application was filed by Dr. Amanda Odoi, a researcher, who argued that the ongoing consideration of the bill violated Article 108 of the 1992 constitution. According to Article 108, Parliament cannot consider a bill or motion that imposes taxation or charges on the consolidated fund or other public funds, unless it is introduced by the president.
The applicant contended that the bill, as a private members bill, would impose charges on the consolidated fund, thereby contravening the 1992 Constitution. Consequently, Dr. Odoi sought an injunction from the High Court to prevent Parliament from further deliberating on the bill until a final decision was reached.
However, a nine-member panel, led by Chief Justice Gertrude Torkonoo, dismissed the injunction application.
