Legal practitioner Lawyer Eric Daning has revealed that, the government cannot prosecute Nana Appiah Mensah popularly known as NAM1 as Chief Executive Officer (CEO) of Menzgold Ghana Limited.
Speaking with Spice Fm Adzekye Mu Nsem NAM1 can only be prosecuted as a Director of the company and not a CEO who is a regular employee thus he did not commit any crime in line with his work.
Lawyer Daning believed there is no law to prosecute Nana Appiah Mensah on criminal basis, and added that, the law states that, ” for someone to be prosecuted the offences for which he is being charged must be stated in a written form and the punishment for that offence must be stated in a written law”.
He further advised the aggrieved customers can only sue him individually under civil offence to auction his assets.
He called on investors to be vigilant of some Ponzi schemes as it is highly outrageous in the system today.
